IMMIGRATION LAW AND HUNGARIAN CITIZENSHIP
EEA citizens have the right to travel to the territory of Hungary with a valid travel document or identity card. EEA citizens are obliged to report their stay within 93 days following the entry by providing personal data in case of stays exceeding 90 days within 180 days. The competent authority shall issue the registration certificate immediately upon notification of the residence.
Third-country citizens (citizens outside the member states of the EEA) may stay in Hungary maximum 90 days within 180 days with a visa. For stays longer than 90 days within 180 days
- residence permit;
- interim permanent residence permit;
- national permanent residence permit;
- EC permanent residence permit;
- EU Blue Card,
- residence card or;
- permanent residence card or
- national visa is necessary.
The intended stay exceeding 90 days within 180 days has general preconditions for any legal title of residence; however the special requirements for each residence purpose should also be taken into consideration.
A residence permit may be issued for specific purposes of stay. These purposes are the following:
- family reunification;
- gainful activity;
- employment;
- studies;
- seasonal work;
- intra-corporate transfer;
- scientific research;
- official purpose;
- medical treatment;
- purpose of visit;
- volunteer activities;
- humanitarian purpose;
- other, different from the above purposes.
When applying for a residence permit for the purpose of employment, the residence permit and the work permit applications are considered in one procedure. The work permit is issued for a specific employer and workplace.
The invitation letter certifies certain conditions of the issue of a residence permit for the purpose of visit. The invitation letter must be certified with a clause, which shall be applied by the inviter. The invitation letter certified by the authority must be sent by the inviter to the invited person who shall attach it to the application for a residence permit for the purpose of visit. The invitation letter does not entitle to entry.
Acquiring Hungarian citizenship
The conditions of obtaining the Hungarian citizenship are complex: all of the circumstances shall be examined to find out whether its conditions exist or not. It is a fundamental right that no one can be deprived of the Hungarian citizenship originated from birth or lawfully acquired. A Hungarian citizen cannot be expelled from Hungary and can return home from abroad anytime. It is an important principle that Hungarian citizens cannot be differentiated based on the acquisition or title of citizenship.
